Brandon was struck from behind by an SUV and killed while his friend Richard McLean, 16, was seriously injured with a broken pelvis and other bones. His other pal Jake Roberts, 16, was knocked off his bike but sustained only scratches.

Now the driver of the SUV, Sharlene Simon, 42, a mother of three, formerly from Innisfil, is suing the dead boy for the emotional trauma she says she has suffered. She’s also suing the two other boys, as well as the dead boy’s parents, and even his brother, who has since died. She’s also suing the County of Simcoe for failing to maintain the road.

Even the family’s lawyer is in shock.

“In all of my years as a lawyer, I have never seen anyone ever sue a child that they killed,” Barrie lawyer Brian Cameron said. “It’s beyond the pale. I just couldn’t bring myself to tell them on the phone.”

wow, what? what a sad story

So this driver was speeding on a dark road at 1:30 AM, half an hour after leaving a bar. No Breathalyzer was done, her husband is a cop and was in a car behind her, he's the main witness. She couldn't stop in time to avoid hitting the kids on bikes. Now she's suing the dead teenagers?

How do you collect from dead teenagers, even if they are in some bizarre universe found liable for their own deaths? that's really weird

Seems legit. I know I would suffer emotional distress, especially while I was doing hard time in state prison.

Sounds like tort reform is needed in Canada, too.

I like having unfettered access to the courts. So, yes, we need reforms to make this access less restrictive. The article says that the families of the children are suing so this woman's suit may just be some sort of tactic. The bigger problem is how she avoided jail.

Sounds like a routine countersuit searching for any amount of liability insurance to me, likely presented by her/their insurance company , maybe on their behalf, maybe on their own. Because we all know insurance companies don't retain lawyers to protect their interests despite what their clients/policy-holders may or may not want.

I learned early in my 30+ years in Law Enforcement; young people out late at night are VERY likely to either get into trouble on their own or, become the victim of someone else's trouble. This is truly sad.
