It gives them the option of telling you the truth. And then you know where you stand. This is a theory that has been bandied about for several years. He says he's quiet because he doesn't want to give attorneys before the bench a "hard time." Not sure what cases would be like if every justice tood that approach. He also famously said he wished his colleagues would "just shut up" but later backed away from that.
