I imagine the real reason he said that is because he was ignorant of the fact that it was a 5-3 ruling. He probably spent a nanosecond searching his chaotic memory banks and just assumed that this ruling was voted on by the justices in the same "all the liberals were on one side and were a minority and the conservatives were on the other side and had a majority" pattern that he's sort of picked up somewhere along the way and that that pattern would have been followed if Scalia or his replacement a president Trump would name would have been in place.
