Being an elected public official essentially means open season on commentary. It is almost impossible to quiet a critic of the president. You can even make openly false claims like the president being born in Kenya. However, some news sources like WaPo are urging restraint in believing Wolff. It referred to the author as a "provocateur and media polemicist", and said his reporting had been questioned before. I wonder if the Trumpeteers will refer to that report as Fake News? There is no way Trump's lawyers would actually follow through on this because the first thing Bannon's lawyers would do is make Trump, Don Jr., J. Kushner and Ivanka go through depositions and they sure as heck would not want to do that.
