depends on how it was acquired.
Ours was a gift from a joint account, and given to my wife, in recognition of all her hard work towards her goals with her triathlon and long distance biking endeavors. But I placed the order, so it is mine. My name is on the receipt, MINE!!!!!!!!!!!!!!!!!!!!!!!!!!!
MAVIC has one of those silly pink minis, so his wife should get it. He claims its hers, but I know better......

In most divorce cases, personal items in the possession of the person are not really fought about. I would guess most people would grab their ipod when they went out the door. Although we have beaver law related cases in Vermont, I haven't seen any ipod related cases, yet.
The much more difficult question legally and technically is what to do with DRM restricted music on the ipod. If you get the ipod without the computer, you can't sync it and you lose all those tunes, right? The low tech way is for one party to get a copy burned to cd, but actually splitting the protected audio (or now video) files would give me a headache.

Oh, that's easy. One gets the left channel audio track, and the other getr's the right channel. As for the video, flip a coin. The winner gets the video track, and the looser gets the audio-only.

For Video you could just de-interlace the video- one person gets the even-fields, the other gets the odd fields.
