“The political left has…” blah blah blah…

The reality is that courts have used this to protect malicious officers who have acted against the law.

The reality is that nobody wants the police to be subject to endless malicious lawsuits. They DO want the police to follow the law. The legal test needs to involve “a reasonable person”. The “back the blue” team is as anti-democracy as the J6 traitors.

Nobody should be above the law.

Re: Qualified Immunity - Fritz - 10-28-2023

it is a dangerous concept.
It is also part of NYS law where lawyers are concerned.

This pretty much sums it up.

It also protects judges and public officials who violate civil rights, and judges who refuse to follow the law.

What I actually haven't seen, is, is it actually codified law, that someone can point me towards, or is it a tradition upheld repeatedly?

I completely understand why it is needed, but I also believe people hide behind it to do harm, intentional or otherwise.

Re: Qualified Immunity - jdc - 10-29-2023

It needs to go.

Every person that says "I will sue you" to a cop and they say "I don't care" is because they *don't*.

It *rarely* if ever effects them. 2 week paid vacation, or maybe move jobs to another city, or get promoted. It takes YEARS for cases to come to court, and by that time the damage has been done.

False arrests, bulls__ tickets, stops, civil rights violations, contempt of cop, or any other things cops do have an IMMEDIATE effect on people. That can last for YEARS.

Spend some time watching some 1A audits on YT.

Wont take more than a few to make your blood boil.

It's a legal principle, but not a legislated LAW.

Never said I was a lawyer. Ever. $1,000 sure. Are you $1,000 sure I have?
