SCOTUS lets Rump end birthright citizenship in 28 states - Lemon Drop2 - 06-27-2025

This is going to be chaos. As if we needed more of that. 

Trump's EO on this will apply to babies born in the 28 states that are not suing him over this.  In effect 30 days from now. 

 I guess the other 22 states get an answer later.

Predictable. This court will sell you whatever result you need, and no logic is too tortured to stop it.
Happy to read between the lines to add power to the President or make corporations citizens.
Ignore the plain, black-and-white words to take away birth right citizenship.
Readily throws up its hands about "Congress didn't say it, can't do anything about it" for protection of reproductive rights.
Declares the plain law on the books is outdated and shall be vacated entirely until SCOTUS seems it updated for voting rights.

"The Supreme Court on Friday backed President Donald Trump’s effort to curtail lower court orders that have hampered his agenda for months. However, it also signaled that the president’s controversial plan to effectively end birthright citizenship may never be enforced."

Hopefully CFDT cannot do only what he wants, but assuming they let him end birthright citizenship in these 28 states and later the other 22 states prevail and find out his executive order was unconstitutional, what happens to the children born during this transition period? Can they get citizenship retroactively?

The headline is a little misleading.
It hasn’t ended, yet, it has been allowed to proceed in the courts with no nationwide ban.
Still going to be a potential CF though.

Each district will have to get a district wide injunction.  Nothing will happen as far as birth right citizenship until the SCOTUS rules in the end.

If the court knows it is going to end up in their lap, just rule and get it over with. The spineless twits on SCOTUS are afraid to just make a decision.

Definite CF. 

Children born in the states with the ban in place will become de facto non-citizens. 

By the time their citizenship is restored at the end of the big case, they will have been deported back to somewhere, with no resources to make the trip back or to fight for their rights.

The ruling and reporting on it is confusing, however, Trump's order can move forward in 30 days in states where no judge has barred it

From NBC News:

"In light of the ruling, the proposal can potentially move forward nationwide, although individual plaintiffs could still file their own lawsuits in those states and the current challengers can still move to reinstate injunctions that are less broad in scope. The court said the executive order would technically go into effect in 30 days."

I fully expect chaos, as the administration has not sorted out the details of how this will work.

This administration hasn’t sorted out what day it is, much less something really complex.  Sad
