Sure is. I ordered a 40GB Sunday night for $199.00. That's why Apple dropped the 40GB on MONDAY MORNING and sell a NEW 160GB for $229.00. Yes, the 40GB is already on the way. No, they could not stop my order. Yes, I will be returning it for a refurbed or new 160GB.

It is not expensive enough that many people return them since most of the buyers are dedicated Apple hobbyists, and the nearly obsolete hardware passed into stone axe reliability before Apple started selling them. I would guess they don't get returned for hardware problems unless someone drops one while it is writing data to the hard drive, or it got zapped in a lightning storm in the first 29 days.
The hard core hobbyists buy Dell Mini 9's for $180, install OS X, and use it as both an ATV and low end laptop.

That's what I do now, but it never really replaced my EyeHome for ease of use. I'll be looking for an ATV hardware update soon since Elgato isn't going to update the software for SL.

I am a hard core hobbyist who has a Dell Mini 9 with OS X used as ATV and low end laptop, AND I own an Apple TV. As someone who owns, operates, and enjoys both, I can tell you, a Dell Mini 9 is no Apple TV. The Apple TV is much, much better.
