I didn't think it was legal to sell outright fakes so blatantly. Is it OK because it doesn't use the Apple logo and just looks like an Nano? I know they bust people at flea markets around here for selling knock off designer bags and glasses, I wouldn't think this was any different.

I believe Apple has a patent on that scroll wheel design, so I don't think they're on solid legal ground with this knock-off.

It is illegal to bring fakes and knockoffs across the US border, but I'm sure it happens all the time.

Here's the text from the article:
"It’s illegal to bring knockoff brands across the border. According to the CBP, “Articles bearing marks that are counterfeit or inappropriately using a federally registered trademark are subject to seizure and forfeiture.”

illegal to import - and no less so for the retailer to sell known illegitimate. doing so suggests questionable practices by the selling retailer of great significance IMHO.
