In the sale of the Craftsman brand Sears retained the right to sell tools under that name for 15 years and continue using their existing sources. They are probably dumping inventory that they no longer need to stock all of the stores they have shuttered.
However, SB&D is suing Sears for how they are marketing Craftsman tools sold by Sears. They were implying that Sears sold the real Craftsman Tools or something to that effect.

Or maybe it's as simple as Sears liquidating inventory before they completely shutter the doors.
