Apple claims jailbreaking will destroy cell towers

(By tinkering with the iPhone’s baseboard processor code), a local or international hacker could potentially initiate commands (such as a denial of service attack) that could crash the tower software, rendering the tower entirely inoperable to process calls or transmit data.

Couldn't anyone with any cellphone potentially do this if they were so inclined???

Why bother sending out "Cease & Desist" letters to no avail when you can have the hackers put in Gitmo for "Terrorist" activities?

It's not like Apple has a business interest in discouraging jailbroken iPhones or anything. They are just speaking for the public good.
