Having a shot is NOT and SHOULD NOT BE illegal. There is a difference between having a drink and being intoxicated or impaired.

Driving while sleepy is not illegal. It probably should be.

I don't have any special crusade against alcohol.

Having a shot is NOT and SHOULD NOT BE illegal. There is a difference between having a drink and being intoxicated or impaired.

Driving while sleepy is not illegal. It probably should be.

According to the police report, he refused a breathalyzer, but the arresting officer noted that he "smelt strongly of alcohol coming off his person and had glassy eyes," and the officer, "observed four out of six clues on the horizontal gaze nystagmus test." As well, the arresting officer remarked that the Boss was, "visibly swaying back and forth while I observed his eyes," and the officer, "observed five out of eight clues on the walk and turn test." Lastly, he took "45 total steps during the walk and turn test instead of the instructed 18."

100% correct. Like most (all?) states, New Jersey has an established legal threshold to establish intoxication: an BAC level of 0.08 or above. Anyone who blows below that is, by legal definition, not intoxicated. There may be other factors an officer can use to establish a suspect's ability to drive, but intoxication is no longer one of them.
