‘ Jussie Smollett denied new trial, faces sentencing for hate crime hoax conviction ‘


“ Former "Empire" actor Jussie Smollett's seemingly endless criminal case is expected to come to a close on Thursday, after more than three years. His bid for a new trial was denied. He now faces sentencing.

Smollett's sentencing began Thursday afternoon, but first his attorneys failed to convince the judge in the case to overturn his conviction or grant him a new trial – a longshot request that is routinely made in criminal cases, but rarely granted.

In December, a Cook County jury found Smollett guilty of five of six counts of disorderly conduct, while acquitting him of the sixth count. Prosecutors had accused Smollett of paying two brothers – Abel and Ola Osundairo – to help him stage a fake racist and homophobic attack against himself in January 2019, and then lying to police about it, in a bid for publicity. The Osundairo brothers were the key witnesses against him at trial.

The disorderly conduct charges are class 4 felonies, carrying a sentence of up to three years in prison. “

‘ A judge in Chicago sentenced Jussie Smollett to five months in jail on Thursday, ordering that the actor be incarcerated for falsely reporting to the police that he had been the victim of a racist and homophobic attack in 2019.

Judge James B. Linn excoriated Mr. Smollett from the bench, saying he had concluded that the actor had premeditated the hoax and that, despite his and his family’s admirable past work in social justice, he had an arrogant, selfish side because he “craved the attention.”

The judge said he was particularly upset that Mr. Smollett’s conduct had hurt other victims of hate crimes at a sensitive time, when America was trying to climb out of a painful past of racism.

“There are people that are actual, genuine victims of hate crimes that you did damage to,” the judge said.

Given the chance to address the court before the sentencing, Mr. Smollett declined, but after Judge Linn read his sentence, the actor defiantly stood up and declared, “I am not suicidal. I am innocent.” As he was taken into custody to begin his jail sentence, he raised his right fist. ‘

He broke the law. Much more perniciously, he gave a reason for Deplorables to believe that every legitimate complaint of racism in this country is just made up.
