My fault, I was thinking that the iTMS songs were AL, but forgot that they're 128.

iTunes files are 128 AAC which is smaller than 128 MP3, and is not a VBR file.

However AAC (and MP3) file can be encoded in VBR, but are not VBR by default or definition.
