"Trump attorney Todd Blanche asked who the DA's Office plans to call as their first three witnesses. Joshua Steinglass from office refused on the basis that Trump has been tweeting about them. Judge Merchan said he doesn't blame the DA's office. Blanche said Trump won't tweet about the witnesses — to which Merchan said Blanche can't promise that. Merchan refused to order the DA's office to name its first three witnesses."

It's not a huge rebuke, but it's something.

Merchan said Blanche can't promise that.

Is that an understatement.

Merchan should have asked Blanch:

'Hey, have ya heard the one about the alligator, the scorpion, and the river?'

His past behavior is finally coming back to bite him in the arse. Took almost 80 years, but better late than never.

I'm not a lawyer, but I watch a lot of actors playing them on the teevee...

...anyway, I thought that a list of witnesses was required.

No surprises allowed.

I guess not.

what was requested was a list of witnesses that the prosecution planned to call on Monday - what is assumed to be the first day of the trial.

Yeah, the defense got a list of all witnesses (even transcriptions of the interviews of those witnesses to authorities). The prosecution is not required (at least in New York law) to present a list of the order the prosecution wants to call witnesses.

Just before court ended for the day, Trump lawyer Susan Necheles renewed her request for prosecutors to extend the professional courtesy of letting them know who the first government witness will be.
The two sides had sparred Thursday over the issue, with prosecutors saying they would not provide witness names in advance because of Trump’s repeated violations of a gag order barring him from talking about witnesses in the case.
Knowing which witnesses are coming is incredibly important to trial lawyers so they can prepare their questions and larger trial strategy.
This time, prosecutor Joshua Steinglass offered a possible concession: to tell Trump’s lawyers the name of the first witness. He warned them, however: “If that should be tweeted that will be the last time we provide that courtesy.” - Times

All witnesses involved in this trial should be offered witness protection.
