I spoke with an Apple employee today who assures me that if I have a Time Machine b.u. from my current 10.8.5 MBA, this should be installable on a '13 MBA even if it ships with Mavs.
Wipe the new machine and restore. Yet, another one at the NYC 14th store, said it wouldn't take 10.8.5.
According to MacTracker, it shipped with 10.8.4.
Other than the 2 previous responses, anyone have any further info?

Can you remind me why you need 10.8 over the latest OS?

I have ProTools 9/10 with Waves 8 plugs running under 10.8.5 (which Waves doesn't "support" but works fine).
There's a $300/yr upgrade fee to Waves 9 (for Mavs) that would also require PT 11 ($300), which I don't much care about right now. They are a new AAX plug.
Trying to reduce my step, essentially.

I'll trade you for a 14" G3 iBook,
or a 14" G4 iBook,
or both.
10.4.11 on G3, 10.5.8 on G4.
Will guarantee no worries about 10.8.4/.5, or Mavs; they just won't work.
So there's nothing to worry about.
OK, I'll throw in a G4 MDD DP, w/ both 10.4.11 and 105.8.
OS's on separate drives, so again no worries about ML or Mavs.
And Ill even toss in an original white flying saucer AirPort Extreme ABS...
which you might be sorry about because it's only "g" speed, and was kinda flaky when last used - but did sorta work.
Shouldn't worry about it, though.
But if you're hell bent on keeping your MBA, it should work w/ ML via a TM 10.8.5 restore.
OK, I'll toss in another G4 tower for the trade, how 'bout a QS dually? Need to save on shipping, so the iBooks/ABS will be packed in the boxes w/ the G4 towers.
Trade assumes your MBA is i7 w/ at least 8GB RAM and 256GB SSD, otherwise the deal is off.

Old version of Pro Tools (for OS 9.2.x) is installed on the QS dually - gotta supply your own PCI card.

Years ago, I was NOT able to use a Time Machine back up to go back a major OS (10.6 back to 10.5).

You need Time Machine AND a 10.8 installer, if it's gonna work at all.
Not hard to make a 10.8 installer with an 8GB flash drive or a hard drive.
...If you make a 10.8.5 boot drive and bring it to the Apple Store, you can play with booting different Macs to see which Macs will boot from it. If you get stopped by an Apple employee, just explain what you're doing and they'll probably help you.

I assumed since he said "Time Machine b.u. from my current 10.8.5 MBA" that he had the ML installer and/or access to a bootable ML clone from his current MBA to facilitate the rollback... I like your peremptory AS stealth/ninja strategy as a further safeguard, though the new refurb should be a pretty safe bet...

thanks all. sounds like I'm good. I have a 10.8 Installer on this one and a back up as well.
Buzz, thanks for the offer. I think I'll pass this time. Beside my current is an i5 with 4G.
However, if you don't have ecycling where you are or a viable donation point, send 'em here.

No need to be stealthy. The Macs at the Apple Store are there for people to play with. Go on in and spend the day telecommuting from a Mac Pro if you want. So long as it's not disturbing other customers, most Apple Stores will let you mess around for hours.
