the order to execute the actual kill operation in place would have to come from the sitting President. actually, i think Obama set himself apart from Bush quite nicely in having Bin Laden in his sights and getting the damn job done. i forget the name of the place where Bin Laden was located during Bush's presidency but much has been made of the fact that Bush did not capitalize on that moment.
