they opened themselves up to it, apparently:

The Santa Ana, Calif., man disguised his intrusive spyware as popular songs, which the victims downloaded into their computers.

it doesn't excuse what he did - but had they not downloaded those "songs," their computers (let's just say it, PCs) wouldn't have been infected.
