Isn't what he's doing illegal?

1) buy $1billion worth of AAPL
2) announce on Twitter that he just bought $1billion of AAPL
3) AAPL goes up 5-10%
4) sell AAPL for $1.1billion

seems like manipulation, but I guess it is only manipulation because stupid people are...well, stupid.
