Try siccing the credit card company on them anyway. You've got nothing to lose, especially if what they are offering is an unacceptable solution. I received defective glasses from Zenni Optical and they tried offering me unacceptable solutions. I sicced my credit card on them. I got the refund.
Zenni is the most recent time I've sicced a credit card provider on a company. I've done this with other companies, too. Some of those situations had large amounts of money involved. So far, I've always gotten the refund. In your case, I'd absolutely give it a shot, especially since you've dealt with so many weeks of agita now.
At the least, it's worth a call to your credit card provider to find out if you can still fight the charge. Like I said, you've got nothing to lose.

P.S. This is one of the reasons why I prefer to use a credit card to pay for goods and services. Fortunately, I don't have to use this "feature" very often.
