Dude. My whole point is that delaying the resolution by speculating on the seller's potential misfortune and not following the rules is ultimately a waste of the buyer's time. All these possibilities of seller misfortune are good reasons not to jump off the deep end and be an a-hole about the situation, but when following eBay procedures there is really never a reason to be an a-hole.
Start the process now, if the thing shows up, great, end the process; if not, the buyer is on his way to getting his money back.
Your question was answered umpteen times so you have a consensus on what to do. Looks like the seller's reputation is crumbling for whatever reason; not a good sign that things will turn around for this transaction.
