As of now, they say this is not their phone.
You will likely need to have an active SIM in that phone.
Keep in mind that the restrictions issue they impose can be odd. I'd still send the email - what does it cost you?
But just owning the phone is not the same as using it with an active SIM.
Again, the iPhone works just fine with my wife's prepaid SIM.
In fact the instructions say (Step 1a)
Already have AT&T Prepaid Service? Swap your SIM to the new phone. if it fits, you're all set!
Then they dive details what to do if SIM does not fit.
