Having a shot is NOT and SHOULD NOT BE illegal. There is a difference between having a drink and being intoxicated or impaired.
100% correct. Like most (all?) states, New Jersey has an established legal threshold to establish intoxication: an BAC level of 0.08 or above. Anyone who blows below that is, by legal definition, not intoxicated. There may be other factors an officer can use to establish a suspect's ability to drive, but intoxication is no longer one of them.
Springsteen refused a breathalyzer test. That is tantamount to an admission of guilt under state law.
