MacBook will not sleep, should Apple replace the battery?

OK, I tried everything (all updates, zapped PRAM, updated firmware). MacBook (8 month old, under warranty + 2 additional years of AppleCare) will not go to sleep.

If I mess up with the settings in the energy saver control panel, it will sleep once or twice, and after that it will dim the screen, but it will NOT go to sleep unless you close the lid or choose sleep from the Apple menu (or press the power button).

Normally, it should go to sleep after a certain time. it does not. This puts premature wear on teh battery, it already has 350 cycles in 8 months! I haven't noticed the problems until recently, wife didn't mention anything (it's her laptop). I want to take it to the Apple genius bar on Saturday and see what they say, do you think I should push for a new battery (and also force them to reinstall the OS or figure out why the damn thing will not sleep?)
