Unless the employee is willing to admit in court he was operating the vehicle without the owners permission and not on company business at the time of the accident. A jury could easily find no liability for the van's owner in that case.

I can't imagine a business, even a small one, having only $10K liability coverage. Talk about underinsured.

The snag is that the employee is family. I'd imagine that the owner is going to have to press charges for grand theft auto and follow through with jail time and restitution for his relative to prove that it was borrowed without the owners permission. Or he can pay the $25k.
