The Philadelphia Inquirer reports:
On Thursday, Superior Court Judge Paula T. Dow ordered Kate McClure, 28, and Mark D'Amico, 35, to transfer the money into an escrow account by Friday afternoon and hire a forensic accountant to review the financial records within 10 days. "The funds should be removed from (D'Amico's and McClure's control) and frozen," Dow said.
More good news, Mr. Bobbitt's attorney took on his case
pro bono!
The bad news, McClure & D'Amico allegedly have spent some of the money on vacations and a new car. Looks like they might be seeing Judge Dow again, real soon!

This is what they should have done from day 1. It is far too easy to "borrow" from such a large cookie jar when the only one to tell you no is yourself. Even with the best of intentions.
From what (little) I've read the wife might be wise to cast off both of these guys. But for all I know she's just as culpable.
Doesn't sound like anyone is going to be telling happy ending yarns.

It will be interesting to see what happens with the forensic accounting. The couple already admitted they "borrowed" funds on occasion.

I wonder if there was a legal requirement that the funds have to be used only for the advertised purpose. If not, they might only face ethical/tax issues and not legal issues. But, in any case, I think billb is right--it should have been escrowed from the get-go.

It was not for them to decide that he should only spend the money as they deemed appropriate. Sounds like they were looking for an excuse to pocket a chunk of the money. It seems to me that they could have set up a trust that would have distributed the funds on a schedule.
GoFundMe project is a good idea but probably awash in scams.

I am interested in the case law that will come from this. In my recollection, this is the largest Gofundme controversy involving intent and actual use of funds. Two untrained people handling 400k for a homeless person with issues is recipie for trouble. Even if they had bought a house and car as they claimed they would do for him, he still had the underlying issues that may have led to his homelessness.
I am interested to see what the forensic accounting will turn up.

Or sounds like they let their guard down and thought as long as it was repaid...
It could just as easily been a complete fraud, with Johnny being a willing conspirator from the jump. They got greedy and tried to cut him out.
Or not.

Let me guess. I'd say in that case, it's Johnny. The upside is with that coming out of 'his' pocket, taxes will be reduced.
He better hope that it's not the same auditor who monitored Apple in their eBook/iBook case.

I hope it shows they weren't the schemers so many want them to be and lesson learned. But if they were crooks, then they need to be jammed.
