It'll be interesting to see how thoroughly this investigation is taken. Leaving him alone for several hours, as has been reported, goes beyond oh-I-got-distracted/forgot/had to run an errand. Coming up with a reason/excuse for why he didn't have a cellmate will also be worth hearing. It's a safe bet the guards themselves will be scapegoated, whether or not they're "most" at fault.

The delay in these answers is more about someone doing their best to form the words and run it by the lawyers first, and less about the "knowing" of it.
