Minor car collision. Should diminished value compensation be part of what I seek?

Our car was damaged in low speed collision. Original story here: https://forums.macresource.com/read.php?1,2757705 Other (insured) party at fault. Their insurance accepts liability and is paying for repairs. Is it a given to seek "diminished value" compensation as well?

In what circumstances should this be part of the equation? Only worth it if car is < X years old / > $X / etc?

I would insist on a loss of value compensation, unless they can prove that there will be no record of damage, such as its title or carfax.

You can ask. When they stop laughing and say no, you can get a sue lawyer and an expert witness. You will end up with a lot less than the original settlement offer.

You should 100% ask for a diminished value payment. It's mandatory in some states. There are several sites that will run an estimate for you (I don't want to recommend any because it's been a good 20 years since I used one).

If they balk at that suggestion, tell them that they can buy the car for its’ proper value.
