You need an iTunes account for the update, and yes once you apply the update it is identical to the newest shipping model.

What a ripoff! by Apple. I cannot imagine having to have an iTunes account...then any future updates I need the iTUnes account? How much is an iTUnes account?

Save even more by buying the refurbished 16GB touch w/o the updates for $329 from the Apple Store online. They have them in-stock now.

I still don't think you get it Sam. The iTunes account is free. This update costs $20 for any pre-update phone because it adds a whole slew of functionality (sort of like buying additional programs or a new OS for a computer..the exact same thing often happens with refurbed computers). The refurbed phones (which are probably simply returns) you're looking to buy didn't come with the updated software. There is no "rip off" involved.

I just got the 8 gig refurbed one with the update from Apple for $250 (thanks dealmac). Quite happy with it. It has some scuff scratches on the back, maybe why it was returned.
