MacBook will not sleep, should Apple replace the battery?

OK, I tried everything (all updates, zapped PRAM, updated firmware). MacBook (8 month old, under warranty + 2 additional years of AppleCare) will not go to sleep.

If I mess up with the settings in the energy saver control panel, it will sleep once or twice, and after that it will dim the screen, but it will NOT go to sleep unless you close the lid or choose sleep from the Apple menu (or press the power button).

Normally, it should go to sleep after a certain time. it does not. This puts premature wear on teh battery, it already has 350 cycles in 8 months! I haven't noticed the problems until recently, wife didn't mention anything (it's her laptop). I want to take it to the Apple genius bar on Saturday and see what they say, do you think I should push for a new battery (and also force them to reinstall the OS or figure out why the damn thing will not sleep?)

Why shouldn't you just reinstall the OS?

I highly doubt they'll replace the battery unless it gets less than 30 minutes runtime. It is considered a consumable item, after all.

I highly doubt they'll replace a battery that is not defective just because of some hypothetical future shortened lifespan that could potentially result (from their point of view) from the owner not calling applecare until way after the problem started.

Why don't you call applecare before going to the genius bar. Their phone support is generally excellent and it's right at the end of your phone.

I do know about the battery, but you may have bigger problems. When my daughter's MacBook had a similar problem, we brought it to the Apple store and they ended up keeping it for several days and replacing the sleep sensor and maybe even the logic board (I can't find the work order right now). Definitely worth having them check it out while it's under warranty.
