S. Bay Students Wearing U.S. Flag Shirts Sent Home

Morgan Hill high school students came to school in red, white
and blue, and got a very public lesson in school politics and
free speech.

The boys came to Live Oak High School on the Mexican
holiday, wearing t-shirts, shorts and shoes emblazoned with
American flags.

Displaying the American flag in public schools is now 'provocative.'
It shows that the enemy is not only within our gates but has taken control.
I wonder how many students were allowed to display the Mexican flag on
Chingo de Mayo. That Vice Principal and Principal should be fired. Period.
Imagine the outrage if the students were gay and told to turn their rainbow
tshirts inside out. I am offended by anyone who demands the rest of us
make any change for their celebration. And any government hired or elected
official who says otherwise should be fired and jailed for betrayal of their
responsibilities!

Beware about your 'rights' issue. Wearing the flag as clothing is a violation of US Code. This code is, of course, not enforced

"§8. Respect for flag

No disrespect should be shown to the flag of the United States of America; the flag should not be dipped to any person or thing. Regimental colors, State flags, and organization or institutional flags are to be dipped as a mark of honor.

1. The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property.
2. The flag should never touch anything beneath it, such as the ground, the floor, water, or merchandise.
3. The flag should never be carried flat or horizontally, but always aloft and free.
4. The flag should never be used as wearing apparel, bedding, or drapery. It should never be festooned, drawn back, nor up, in folds, but always allowed to fall free. Bunting of blue, white, and red, always arranged with the blue above, the white in the middle, and the red below, should be used for covering a speaker's desk, draping the front of the platform, and for decoration in general."

I always found it rather amusing that people would proclaim their patriotism by violating that code. Personally, I don't care if you wear a flag t-shirt or not (although flag shoes does seem a bit disrespectful), but it is ironic.

Oh, and El Senor títere---

Most school policies are written to prohibit attire that "may be offensive or disruptive" to the other students. This includes opposing team shirts, naughty words, pictures of the principal with a mustache drawn on it, etcetera.

Schools work very hard to reduce disruptions in their classes, especially in high schools where the simple overload of hormones flowing through the halls produces a systemic disruption all by itself. Such a request is normally handled situationally. Inasmuch as the 'patriotic' students obviously wore the shirts as a deliberate attempt to piss of the Mexican students, then the principal's response was measured and reasoned. A similar response would be expected if the Goth kids wore "Cheerleaders Stink" T-shirts to the Homecoming Pep Rally.

Finally, K-12 schools are NOT supposed to allow 'free speech'. And there has been case law that states that (and no, I don't have a cite, use your own Lexis-Nexis access). Teaching the little darlin's is tough enough without telling the teachers you can't make the kids STFU.

So... If you really want to protest against Cinco De Mayo, wait until next year, travel to East LA, and wear your American Flag T-Shirts and carry your "Wetbacks Go Home" signs.

Just be sure to leave a clear note stating organ donor status and next of kin.
