Names on note vs. names on deed

When refinancing a home loan do the names on the note and the deed have to be the same?

Are they the same people? The bank will likely have everyone sign a form listing all previous names used (at least they do that here).

If they are different people, then the simple answer is yes (there could be a more complicated answer in the situation is complicated).

Run it by your real estate agent, bank or lawyer, a phone call should do.

is it a homestead property? Then parties on the deed have to sign the mortgage-dower's law-.

Would you want to loan money on collateral which is titled to more than one entity without having all entities acknowledge the debt?

Yes, generally, but there are discrepancies on occasion, like middle initials. I forget how this is dealt with, but it may be an "AKA" situation.

If your deed is a Deed of Trust, the names will be different. It will mention and name a Trustee,
