O'Reilly last night. There was no mention of the newspaper. He then had someone give legal opinions later.

Even while the cops know they are being recorded, they use intimidation to try to force the driver to roll down the window and then refuse to provide name & badge number, which they are legally required to provide. I think the people who recorded the confrontation might have been trying to expose something they view as having racial overtones, however, I don't believe the actions of the police were racist; they simply felt challenged that their orders weren't being followed and their ID was being requested. The cops are in the wrong, here, and will lose this case. Furthermore, surely these traffic stop points violate a citizen's rights against unreasonable search and seizure and the practice should be challenged.

...and who's going to make a recalcitrant officer comply?

I'm just curious what the video makes obvious as far as other motives for checking people? That's what I was expecting to see, but I didn't see anything in the video to indicate what they might be checking for. And come on! The police used intimidation to force the driver to comply? They have guns. They make people comply. That's what they're for. It would scare me if they offered him a candy bar to roll his window down. I don't think the video exposes anything. kj. |
