Asking or not asking a question about boring cases such as this bankruptcy, as well as the very nature of SCOTUS is not political.

I would check the transcripts, but they cost $$ thru westlaw... (I HATE our 'for fee' court document system.) This is a theory that has been bandied about for several years.

It's true, the last time Thomas asked a question during oral argument was Feb. 2006.
He says he's quiet because he doesn't want to give attorneys before the bench a "hard time." Not sure what cases would be like if every justice tood that approach.
He also famously said he wished his colleagues would "just shut up" but later backed away from that.
