It's not legal to smoke at Hempfest either, they just don't enforce it.
This whole thing bothers me quite a bit. I'm extremely allergic to it. If someone is smoking 30' from me and I can't get out of the smoke within a few minutes, I get a migraine, vomiting, loss of vision... pretty well incapacitates me for the better part of a day, depending on exposure. Doing some research, I'm not alone. Since it's illegal, there's not a lot of data on it. And we're passing these laws legalizing it so people can entertain themselves while not even checking to see what problems it may cause.
