Yes, you'll need to install the new OS.

You can't migrate from Time Machine to a lesser version of the OS than was used to make the backup.

EDIT DISREGARD - IT IS WORKING.

I’ve gotten up to the part of the installation that tells me I need to AGREE to the terms - but the AGREE button is grayed out. I tried scrolling though the whole agreement text to see if that was necessary but it's still grayed out....??
