That's not in any way how it works.
A friend of mine was killed in a crash where a driver in the opposite lane crossed over while texting and hit his motorcycle head on. There were witnesses. Obvs the police were on scene in minutes.
FYI the police didn't "take his drivers license on the spot" nor did they give him a ride anywhere. His GF came and got him. Police did not even impound his car--it was simply towed away.
It took the police nine months to finally charge the guy.
