Probably fair. However, I often wear earbuds in my ears while driving. My iPod or iAudio is often sitting in my pocket while I am out an about and when I get in the car I'm too lazy to take the earbuds off.
Mind you, I think I would be fine legally, because the devices are turned off and I usually only leave one earbud in, using the single ear as a placeholder for the buds. Probably looks like a cellular hands free set from the distance. I do think it silly to listen to earphones while driving, but not that much more outrageous than cranking the automobile's audio system up so loud that you cannot hear either.
