Do you think a fine is fair for wearing buds?

It's ridiculous (and illegal here) to wear headphones, earbuds, etc while driving (or riding a bike). It will be illegal to use a cell phone handset in a few months (not soon enough IMHO). I avoid cell phone use in the car, but for the few occasions I do (i.e. straight highway, no intersections), this system works really well for me http://www.blueant.com.au/supertooth2.htm . The level of distraction doesn't seem any different than talking with a passenger.
